RESTORATIVE JUSTICE IN DEFAMATION CRIME:CHALLENGES AND OBSTACLES IN INFORMATION DISCLOSURE ERA

Abstract
Defamation through social media is legal polemic due to the legal provisions are often regarded
as a rubber article (hatzaiartikelen) to criminalize someone so that a maximum law enforcement effort is
needed. This research is a normative legal by using statute, case, and conceptual approaches. Meanwhile, the
data were analyzed descriptively and qualitatively with citations and content analysis. The results of the
research showed that defamation through social media is an offense after the revision of Electronic Information
and Transaction Laws which enabling the victim to revoke his report from the police if a peace agreement had
been reached between the victim and the perpetrator. The restorative justice approach can be taken in handling
defamation through penal mediation between victims and perpetrators by considering certain aspects including
the fulfillment of the perpetratorsí responsibilities to the victims, the losses arising from the act is not too large,
and a peace agreement between the victim and the perpetrator by revoking his report from the police.
